GENERAL TERMS AND CONDITIONS

 

Application scope

The general terms and conditions set out here (hereinafter: “T&Cs”) apply to all orders and purchases of candles and accessories (hereinafter: “Products”) on the website www.candeledigiorgio.it (hereinafter: “Website”) managed by Cereria Di Giorgio SpA, with registered office in Via della Cereria 11, 00040 Pomezia (Rome) VAT number 00885911008, tax code 00411710585, which deals with the supply of the Products.

Cereria Di Giorgio deals with the sale of the Products through the Website. Purchases of the Products made through the Site will see Cereria Di Giorgio as parties, as the seller and the subjects who proceed with the purchase of one or more Products can be:

  • Private customers, for purposes not related to their entrepreneurial, commercial, artisanal or professional activity, as a buyer.
  • Customers who purchase for non-personal use as traders, wholesalers, retailers and professionals. For this type of customer, purchase operations will be regulated by the rules of the Civil Code.

Cereria Di Giorgio is party to these general conditions of sale and owner of the rights to the domain name of the Website.

Any communication from the Consumer connected and/or related to the purchase of the Products - including any reports, complaints, requests concerning the purchase and/or delivery of the Products, the exercise of the right of withdrawal, etc. – must be sent to the Seller at the e-mail address customercare@cereriadigiorgio.it or by fax at +39 069120427.

Each purchase is governed by the general conditions of sale in the version that will be published on the Website at the time the order is sent by the Customer.

 

Warnings

  1. The Customer is required to carefully read the T&Cs before placing any purchase order.
  2. By accepting the T&Cs and placing an order, the Customer declares:
  3. to be a consumer in accordance with the provisions of the art. 3 of the Consumer Code;
  4. to be of age;
  5. that the data provided by the same for the execution of the Contract are correct and truthful;
  6. that I have read, understood and accepted the T&Cs fully and without reservation;
  7. to authorize Cereria Di Giorgio to store, process, use and transfer the (personal) data contained in the order to third parties and/or abroad for the purpose of executing the same.
  8. Cereria Di Giorgio does its best to ensure that the information contained in the Website is accurate and up-to-date. However, no guarantees can be offered in this regard. The Customer acknowledges and accepts that the Products may not fully conform to the indications, specifications and/or photographs on the Website.

 

Orders

  1. The sales contract between Cereria Di Giorgio and the Customer is to be considered finalized with the sending of the written confirmation of shipment to the Customer, to the e-mail address indicated by the latter with the purchase order.
  2. There is a minimum order amount of 20.00 Euros excluding VAT, below which the system does not allow you to formalize the order.
  3. Cereria Di Giorgio will consider any requests for cancellation of the order received before shipping the Products to the customer.
  4. In the event that a specific Product present in the Customer's order is no longer available, Cereria Di Giorgio will have no obligation to supply the Product in question, but will only be required to promptly inform the Customer of this circumstance. If only part of the Products indicated in the order are available, Cereria Di Giorgio will contact the Customer to ask him if he intends to cancel the order or is willing to receive only the available Products; in this case the Customer will only be charged for the amount relating to the Products he will receive.
  5. Cereria Di Giorgio reserves the right to reduce, at its free discretion, the quantity of Products that can be purchased on the Website.
  6. It is also specified that the images relating to the descriptive sheet of a product may, in some cases, not be perfectly distinctive of its characteristics but differ in some details. All information reported and related to the purchase (terms, descriptions, purchasing guide, etc.) are to be understood as simple generic information material.

 

Prices

  1. The prices of the Products, expressed in the currency shown in the cart, will in any case be those indicated on the invoice. Cereria Di Giorgio will however do its best to ensure that the prices indicated on the website are correct and updated.
  2. For each order placed on the Site, if the Customer has expressly requested it at the time of the order and has provided a valid VAT number or valid tax code when registering the Customer Account, Cereria Di Giorgio issues an invoice for the material shipped, sending it via email to the order holder, pursuant to art. 14 Presidential Decree 445/2000 and Legislative Decree 52/2004. For the details reported when issuing the invoice, the information provided by the Customer at the time of the order is valid. In fact, no changes to the invoice will be possible after it has been issued.
  3. Shipping and delivery costs may vary depending on the country and will be charged to the Customer upon shipment of the ordered Products, based on the shipping rates in force reported in the relevant section of the website.
  4. Payment will be made by the Customer at the time of shipping confirmation by credit card or in the other methods indicated in the relevant section of the Website.

 

Delivery

  1. Delivery of the Products will be made to the delivery address indicated by the Customer in the order. Cereria Di Giorgio does not deliver to a post office box address or to post offices enabled for the Fermoposta service, for security reasons. Disputes for goods shipped and not delivered, or delivered to a person other than the one indicated, or any signature disavowals, must be communicated to the email address customercare@cereriadigiorgio.it or by fax to the following number +39 069120427. Complaints regarding goods received with broken packaging or with an open or damaged package must be reported directly to the courier by writing together with the signature "subject to control", at the time of acceptance of the package. In these cases, the Customer will also be required to notify customer service within one (1) day of receiving the goods.
  2. In principle, the Products will be delivered within 7 (seven) days of order confirmation by Cereria Di Giorgio, it being understood that delivery times may vary depending on the country of destination.
  3. Cereria Di Giorgio reserves the right to refuse, suspend or cancel, at its own free discretion, the delivery or fulfillment of any of the obligations deriving from the sales contract, in case of alleged fraud, default or violation by of the Customer of obligations assumed towards Cereria Di Giorgio with previous orders and/or sales contracts. If the Products ordered require crossing customs (depending on the country of destination) and the Customer decides to no longer receive the order once it has arrived at customs, Cereria Di Giorgio will not grant a refund of the goods which will abandoned on site.

 

Right of withdrawal

  1. Pursuant to art. 64 Legislative Decree 6 September 2005 n. 206, if the Customer is a Consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form to Cereria Di Giorgio), he has right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, within 14 working days from the date of receipt of the goods.
  2. Upon receipt of the Products by Cereria Di Giorgio, the sales contract will be deemed canceled for all purposes and all related obligations, rights or claims will lapse, it being understood that if the Products returned to Cereria Di Giorgio are damaged, Cereria Di Giorgio will have the right to compensate such damage with the payment for the Products already made by the Customer. 
  3. In addition to what is indicated above (articles 15-16), the right of withdrawal is subject to the following conditions:

Within fourteen (14) calendar days from the date of receipt of the Products by the Customer. the Customer must contact Cereria Di Giorgio customer service – via fax at the following number +39 069120427 or by sending an e-mail to the address customercare@cereriadigiorgio.it – in order to obtain authorization to proceed with the return (“RMA”);
  5. The right applies to the product purchased by the Customer considering it in its entirety. It is not possible to exercise withdrawal only on part of the product purchased.
  6. Pursuant to article 55 of Legislative Decree 6 September 2005 n. 206, the right of withdrawal is excluded in the event that the sale concerns products made to measure or personalized or which by their nature cannot be returned or risk deteriorating or expiring rapidly.
  7. After receiving the RMA, the Products must be returned to Cereria Di Giorgio, at the risk and expense of the customer, with a single shipment by courier or registered mail within 2 (two) days from the date of receipt of the RMA to the following address: Cereria Di Giorgio, via della Cereria, 11 – 00071 Pomezia (RM).
  8. In the event of non-delivery of the returned package, Cereria Di Giorgio will ask the customer for proof of delivery, i.e. the slip bearing the signature of the person who received the returned package. If the customer does not provide proof of delivery, Cereria Di Giorgio will not be able to grant a refund.
  9. the Product being returned must not have been used, worn or damaged;
  10. the Product packaging must be intact;
  11. the Product must be returned in the original packaging, complete in all its parts and components.
  12. As soon as it is able to confirm that the conditions have been met, Cereria Di Giorgio will send the Customer an email confirming acceptance of the return and will start the refund procedure so that the Customer receives a refund of the amount paid. for Products returned within the following thirty (30) days, regardless of the payment method previously adopted by the Customer. The reimbursement of the amounts paid by the Customer will always be made exclusively in favor of the Customer who made the payment. The refund of returns resulting from orders paid with the cash on delivery formula will be refunded only to Italian current accounts.
  13. In the event that the above conditions have not been respected, the Customer will not be entitled to a refund of the amount paid to Cereria Di Giorgio. However, the Customer will only have the right to have the returned Products returned, at their own risk and expense. If the Customer does not request to receive the returned Products back within thirty (30) days of the relevant communication from Cereria Di Giorgio, Cereria Di Giorgio will have the right to retain them together with the amount received in relation to the transaction.

 

Warranty and limitation of liability

  1. All products sold on the Site are covered by the Legal Guarantee of Conformity provided for by articles 128-135 of the Consumer Code ("Legal Guarantee"). The Legal Guarantee is reserved for Consumers.
  2. This guarantee is reserved for the private consumer (natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number reference in the order form). In the event of a lack of conformity, Cereria Di Giorgio provides at its own discretion: to restore the conformity of the product through replacement without costs for the Customer or to reduce the price or refund the amount paid.
  3. Cereria Di Giorgio's guarantee is limited to any obvious defects in the Products - excluding, without limitation, any implicit guarantee regarding the quality and suitability for the purpose for the Customer - for a period of 2 (two) years from delivery of the Products .
  4. The guarantee only gives the right to obtain a refund of the amount paid for the defective Products, provided that the defect is communicated to Cereria Di Giorgio within 2 (two) months from when it was discovered.
  5. In addition to what is indicated above (articles 20-21), the right to reimbursement is subject to the following conditions, under penalty of forfeiture of the guarantee:
  6. Before sending back the defective Products to Cereria Di Giorgio, the Customer must contact Cereria Di Giorgio's customer service - by calling the number 06.9122943 or by sending an e-mail to customercare@cereriadigiorgio.it – to have authorization to proceed with the return;
  7. Defective Products will be collected by Cereria Di Giorgio at its own expense.
  8. Once the Product has been received and its defectiveness has been ascertained, Cereria Di Giorgio will send the Customer an email confirming acceptance of the return and will start the refund procedure in favor of the Customer of the price paid for the defective Product which must be completed within thirty (30) days, regardless of the payment methods previously adopted by the Customer. The reimbursement of the amounts paid by the Customer will always be made exclusively in favor of the Customer who made the payment.
  9. Without prejudice to the above guarantee, Cereria Di Giorgio excludes any and all liability (contractual or non-contractual) towards the Customer, within the limits of the applicable mandatory rules.
  10. The maximum limit of overall liability borne by Cereria Di Giorgio cannot in any case exceed the amount paid by the Customer for the purchase of the Product.

 

General provisions

  1. In the event that one or more provisions of these T&Cs should be void, voidable, illegal or ineffective, this will not result in the total ineffectiveness of the T&Cs. The provision in question will be replaced by a similar valid provision that duly takes into account the intention and content of the same, in compliance with and pursuant to the regulations in force.
  2. These T&Cs are subject to Italian substantive law. Any disputes that may arise will be referred to the exclusive jurisdiction of the competent court of Rome.

The Web site www.candeledigiorgio.it and all materials contained therein such as, by way of example and not limited to: texts, images, photos, graphics, animations and videos, are protected by copyright.
